1. ABOUT US
Harbans Mahajan Real Estate Consultants Pvt. Ltd. is a real estate consultancy and brokerage company providing services including:
- Fresh / Original Bookings of residential and commercial properties offered by developers/promoters;
- Sale and purchase of residential and commercial properties in the resale/secondary market;
- Residential and commercial leasing and rental services;
- Real estate consultancy and advisory services; and
- Assistance with property documentation and transaction-related processes.
HMREC is a RERA-registered real estate agent and operates in accordance with the applicable RERA requirements in the States where it is registered.

2. PROPERTY AND PROJECT INFORMATION
Our website may contain information relating to residential and commercial properties/projects marketed by HMREC as a real estate agent, channel partner or marketing partner.
Project information, including prices, specifications, unit sizes, floor plans, amenities, photographs, brochures, offers, payment plans, possession timelines, approvals and other details, may be provided by the concerned developer/promoter or other third party. HMREC generally relies upon such information and marketing materials and does not independently certify their accuracy or completeness.
The concerned developer/promoter or relevant third party shall be responsible for the accuracy and authenticity of the information and materials provided by them, subject to applicable law.
Customers are advised to independently verify material information, including applicable RERA registration and project details through the official website/portal of the concerned State RERA authority, and from the relevant developer/promoter and statutory documents before making any booking, payment or investment decision.
3. FRESH / ORIGINAL BOOKINGS
HMREC may facilitate fresh/original bookings of residential and commercial properties offered by developers/promoters.
In such transactions, HMREC acts as a real estate agent/channel partner/facilitator and is not the developer, promoter, constructor or owner of the project unless expressly stated otherwise.
Bookings, allotments, payments, construction, possession and other matters shall be governed by the terms and documentation of the concerned developer/promoter and applicable law.
4. RESALE AND LEASING TRANSACTIONS
HMREC may facilitate the sale and purchase of properties in the resale/secondary market and residential or commercial leasing/rental transactions.
The terms of each transaction shall be governed by the relevant agreements and documents executed between the respective parties.
Information relating to resale or leasing properties may be provided by the concerned owner, seller, lessor or other relevant party and should be independently verified before entering into a transaction.
5. DOCUMENTATION, LEGAL, TAXATION AND KYC ASSISTANCE
HMREC places special emphasis on proper documentation and compliance in property transactions.
We assist and coordinate, as applicable, in the preparation, review and execution of property-related documents and endeavour to ensure that applicable KYC, documentation, legal, statutory and taxation requirements are appropriately addressed.
Where required, we may coordinate with or recommend qualified legal, taxation or other professional advisors.
Our assistance is intended to facilitate a properly documented transaction. Unless specifically agreed otherwise in writing, HMREC does not provide independent legal, tax or financial advice and does not replace the role or responsibility of qualified professional advisors.The parties to the transaction remain responsible for providing complete, accurate and authentic information and documents.
6. PRICES AND AVAILABILITY
Property prices, availability, specifications, offers, discounts, payment plans and other commercial terms may change without prior notice.
The display of any property or project on our website does not necessarily mean that it is currently available.
Availability shall be subject to confirmation from the concerned developer/promoter, property owner or other relevant party.
7. NO OFFER OR BOOKING CONFIRMATION
Information published on this website or an enquiry submitted through the website does not constitute a booking, allotment, offer, acceptance or confirmation of any transaction.
Any sale, purchase, booking, lease or rental transaction shall be subject to separate agreements, documentation and applicable terms and conditions of the concerned parties.
8. MARKETING MATERIAL AND INTELLECTUAL PROPERTY
The website may contain photographs, images, logos, trademarks, brochures, floor plans, videos, project information, advertisements and other marketing materials belonging to or provided by developers, promoters, property owners or other third parties.
Such materials may be displayed by HMREC in its capacity as a channel partner, marketing partner or real estate agent, where HMREC is authorized or otherwise permitted to use them.
The respective developer, promoter, property owner or other rights holder shall remain responsible for the ownership, accuracy and authenticity of the materials and information provided by them.
HMREC does not claim ownership of third-party logos, trademarks, photographs, brochures, videos, project materials or other intellectual property belonging to the respective rights holders.
All intellectual property rights in such third-party materials remain with their respective owners.
9. THIRD-PARTY INFORMATION AND WEBSITES
HMREC may provide links to, or display information and materials relating to, developers, promoters, builders, property owners and other third parties.
Where such information or material has been supplied by a third party, HMREC relies upon the information as provided by that third party.
HMREC shall not be responsible for any subsequent change, inaccuracy, omission or discrepancy in third-party information or marketing material, to the extent such matter originates from or is attributable to the concerned third party.
Customers are advised to verify all material information directly with the concerned developer/promoter, property owner or other relevant party and to rely upon the final contractual and statutory documentation applicable to the transaction.
10. RERA
HMREC endeavours to comply with the applicable provisions of the Real Estate (Regulation and Development) Act, 2016 (RERA) and the applicable rules and regulations in the States in which it operates.
HMREC’s RERA registration does not constitute a guarantee or certification regarding the performance, quality, financial position, construction, possession or other obligations of any developer/promoter or project.
Nothing in these Terms shall exclude or limit any responsibility or liability of HMREC that cannot lawfully be excluded or limited under applicable law, including obligations applicable to HMREC in its capacity as a registered real estate agent.
11. WEBSITE USE
You agree to use this website only for lawful purposes.
You shall not misuse the website, attempt unauthorized access, introduce malicious software, interfere with its operation or use website information for unlawful or fraudulent purposes.
12. COMMUNICATIONS AND PRIVACY
When you submit an enquiry or provide your contact information through our website, HMREC may use the information to respond to your enquiry and provide information regarding properties, services, appointments and relevant communications, subject to applicable law.

15. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of India.
Subject to applicable law, disputes relating to these Terms or use of this website shall be subject to the jurisdiction of the courts having appropriate jurisdiction over the registered office of HMREC.
